Back in 2017, the Court of Justice rejected the Commission’s ruling, highlighting that the General Court failed to scrutinize all of Intel’s contentions as necessary. Resultantly, it decided to overturn the General Court’s verdict due to this analytical lapse, thereby referring the matter back to the General Court for further examination “to evaluate, considering Intel’s arguments, whether the discounts in question could impede competition.”
However, that wasn’t the conclusion.
Fast forward to 2022, after a comprehensive assessment of the arguments presented by both sides, the General Court declared that “the assessment conducted by the Commission is deficient and, in any case, fails to conclusively confirm that the discounts in question had, or were likely to have, anticompetitive implications.” Hence, the General Court revoked the decision.
